Kevin has a passion for creating practical solutions that allow his business clients to minimize legal risk without being sidetracked with workplace issues.

His driving force is his dedication toward his clients; continually striving to help them achieve their goals. With particular expertise within the healthcare industry, Kevin’s deep level of expertise puts him in a position to spot issues before they become problems. By guiding executives and HR professionals through labor and employment law matters, such as sensitive termination issues and high-level investigations, his practice is people, not contracts, so forging relationships is always his primary goal. 

Kevin advises and defends employers both inside and outside of the courtroom in a wide range of employment-related issues. He has substantial experience with non-competition agreements, leave and accommodation concerns, discrimination and harassment matters, internal investigations, discipline and discharge decisions, reductions in force, wage and hour compliance and workplace policy and safety issues. Kevin also assists his clients in structuring the employment aspects of complex merger and acquisition transactions.

When litigation is unavoidable, however, he is a zealous advocate for his clients, with a successful track record in litigation including and extending beyond employment matters. He represents a wide variety of businesses, physicians and individuals, with a heavy emphasis in the healthcare arena, in complex litigation areas such as licensure issues, partnership conflicts and trade secret and non-competition disputes.

A native Texan, Kevin is heavily involved in how labor and employment issues affect his community and clients both locally and on a national level. He recently served on the board of directors for the local chapter of the Society of Human Resources Management and is regularly called upon to provide feedback on how proposed legislation and new laws may change workplace practices for businesses and otherwise impact employees.

  • Defended employer in a two week workers’ compensation retaliation jury trial involving life-threatening injuries to employee. Secured complete defense verdict of no liability and zero damages.
  • Obtained dismissal of race discrimination and retaliation claims made by longtime employee of nationwide hospital system.
  • Achieved complete summary judgment dismissal for Fortune 500 employer and distributor with regard to Title VII disparate impact, hostile work environment and failure to promote claims based upon race.
  • Obtained injunctive relief for international employer in enforcing noncompetition agreements of multiple sales representatives attempting to leave company to work for direct competitors.
  • Secured defense verdict in week-long jury trial involving age and disability discrimination claims brought by longtime employee of electricity transmission utility.
  • Worked with management, in-house counsel and human resources personnel of physician group to provide employee relations strategy, implement new policies and employee code of conduct, and prepare new employee handbook.
  • Defended hospital in harassment claim brought by physician against executive and achieved favorable resolution for client.
  • Represented home healthcare company in securing dismissal of wage and hour claims brought against it by former employees.
  • Assisted healthcare group in evaluation of employee contracts and liabilities in purchase of physician practice.
  • Defended healthcare group and management company in Fair Labor Standards Act lawsuit where plaintiffs alleged they were misclassified as independent contractors.
  • Secured defense verdict in bench trial involving hostile work environment and retaliation claims for healthcare/real estate investor.
  • Assisted hospital client in investigation and defense in whistleblower claims and related administrative and civil actions. Achieved favorable resolution.
  • Represented charter air transport company in dozens of employee contractual lawsuits and disputes, each resulting in defense verdict or favorable settlement.
