The intellectual challenge of real-time problem-solving for clients is what Dieter finds most compelling about litigation.

Working with others – collegially but competitively – drew Dieter to a career in law. He has handled all phases of litigation, including pretrial hearings and motions, trials and appeals in state and federal court. 

He regularly defends shareholders, companies ranging from startups to large corporations and other stakeholders in a wide variety of quickly moving business-to-business matters that can involve injunctions and restraining orders. He assists clients with noncompete agreements, trade secret claims, professional liability claims and insurance coverage matters, among other issues.

He enjoys the day-to-day complexity of guiding clients to protect their reputations and business assets.

  • Represented two former executives and their startup company at temporary restraining order hearing and cross-examined opposing party's witness within 24 hours of retention. Court ordered less than 25 percent of opposing party's sought restraint.
  • Represented insurance executive in action alleging violations of restrictive covenants where matter resolved without liability or damages.
  • Represented Milwaukee area dentistry in action alleging defamation along with statutory and civil conspiracy wherein all claims were dismissed following motion practice.
  • Defended large Wisconsin municipality in federal court. RICO claims were dismissed and civil rights claims were settled for nominal percentage of plaintiffs' alleged damages.
  • Represented national beverage manufacturer in pursuing breach of fiduciary duty, conspiracy, tortious interference and trademark violation claims against client's former sales personnel.
  • Successfully defended national insurer in federal court against claims of breach of duty to defend and bad faith. Matter settled for less than 5 percent of plaintiff's alleged damages following motion practice.
  • Navigated expedited negotiations, hearings and discovery for state insurance department client in disputed rehabilitation and subsequent liquidation proceedings. Team counsel avoided trial, resulting in significant client cost and time savings, thus preserving and maximizing estate assets.

Outside the Office

Dieter enjoys golfing, and is a baseball and football fan, particularly of the Milwaukee Brewers and the Green Bay Packers. He and his wife stay busy with three young children, who love attending – if not exactly watching – games with their parents.
