Experience

Insurance Litigation & Compliance

  • Served as Secretary to the President of arbitral tribunal in international arbitration proceedings involving denial of insurance coverage for $1.2-billion risk and multimillion-dollar securities and valuation dispute. Drafted procedural orders, communications with counsel, decisions on discovery requests (Redfern Schedule) and partial and final awards.
  • Represented various insurers in complex commercial coverage matters, including disputes arising under Commercial General Liability (CGL), directors and officers/fidelity, professional liability, reinsurance and first-party property policies.
  • Assisted major insurance company in revamping corporate compliance department by drafting new code of conduct, installing internal investigations processes and anticorruption directives, as well as hosting company's employee workshops.

Financial Litigation

  • First-chaired administrative proceedings before regulatory agency Brazilian Superintendence of Private Insurers (SUSEP), amounting to nine appellate wins and more than $2 million in overturned regulatory sanctions.
  • Represented financial institutions and minority shareholders before Securities and Exchange Commission of Brazil (CVM).

A proud University of Michigan alumnus, Bernardo follows Wolverines football and basketball. The sports he enjoys playing himself are soccer and volleyball. And he’s a devoted reader who reboots each night by reading at least a couple of pages, even as he and his wife are busy with two very young children.
