Overview

Megan draws upon her background in civil engineering and two decades of legal practice to advise clients on virtually all areas of environmental law.

Megan advises clients on virtually all facets of corporate operations that touch upon environmental law. Her experience is broad-based, and she routinely provides counsel on issues arising under:

  • Resource Conservation and Recovery Act (RCRA)
  • Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA)
  • Clean Air Act
  • Clean Water Act
  • Endangered Species Act
  • National Environmental Policy Act (NEPA)
  • Occupational Safety and Health Act (OSHA)
  • Federal Mine Safety and Health Act (MSHA)

Megan represents clients regarding complex compliance and permitting issues under federal and state environmental regulatory programs. She also coordinates clients’ environmental remediation efforts, leading and collaborating with internal and external consultants.

In the transactional setting, Megan frequently heads up environmental due diligence efforts for clients engaged in mergers and acquisitions, real estate transactions, and corporate finance. Clients appreciate her practical approach to tackling real and potential environmental liabilities in the deal context, where she drafts and negotiates environmental representations, warranties and indemnities, and escrow and holdback arrangements, as well as advising clients regarding environmental insurance for transactions with potential environmental liabilities.

Megan’s regulatory and transactional experience is reinforced by a strong litigation background, providing clients with a 360-degree perspective on how environmental law challenges can impact their business. She has made numerous appearances in state and federal court representing clients on a variety of issues, including CERLCA/Superfund cost recovery and defense, environmental insurance coverage, and Prop 65 citizen suits. She works closely with technical consultants and manages and directs large teams of lawyers who handle all phases of litigation.

Prior to entering private practice, Megan worked for a national civil engineering firm and as an environmental consultant for two international environmental consulting firms, where she drew upon her knowledge of environmental engineering and hydrology for a variety of major projects.

Megan is the Managing Partner for the firm's Phoenix office.
