Brandon counsels clients on healthcare regulatory matters, employee benefits, and ERISA—and the intersection between the three.
Brandon represents hospitals, health systems, physicians and other providers, physician groups, pharmacies, and healthcare private equity investors with a primary focus on general regulatory compliance. He has also assisted long-term care facilities and organizations with certificate of need approval, and he regularly represents these clients in enforcement matters and appeals of citations. Alongside his healthcare regulatory work, Brandon has extensive experience advising on employee benefits and ERISA matters, including ERISA fiduciary duty compliance and the overlap between benefits, ERISA, the Healthcare Insurance Portability and Accountability Act (HIPAA), and the Affordable Care Act (ACA).
He also calls upon his public policy background, serving as adjunct faculty at Saint Louis University School of Law’s Center for Health Law Studies, where he co-teaches the course Grassroots Policy and Advocacy, an experiential learning course that identifies issues impacting children and families in Missouri. The class works with legislators to draft and pass legislation during the spring semester by taking frequent trips to the state capital to lobby legislators and testify before various committees.
Brandon frequently authors and presents on various topics, including rural emergency hospital designation compliance and conversions, ERISA preemption issues, ERISA litigation updates, and state abortion law changes.
Prior to his legal career, Brandon sold medical devices for a national cardiac monitoring company and often found himself advocating for patients. He enrolled in law school partly out of a desire to become a more effective advocate, and he focused his studies on both health law and employment law, developing a thorough understanding of the niche area of ERISA and related benefits. He’s fascinated by the increasing overlap between healthcare regulations and benefits laws, and he thrives on the intricacy of ERISA rules.
With a keen business sense, Brandon is passionate about helping clients navigate risk and legal complexity. He knows benefits regulations are a challenging area where it’s easy for organizations to face class action suits, and he partners with clients to ensure their plans are protected.
