Overview

Erin defends clients in asbestos and other toxic tort litigation in three of the country’s most difficult jurisdictions.

For the past decade, Erin has represented a wide variety of clients, from Fortune 500 companies to small family businesses and government entities, in toxic tort, product liability, and environmental matters in New York, New Jersey, and Pennsylvania. She has extensive courtroom experience, second chairing jury trials early in her career and working with cases from inception to trial. Erin has also coordinated multijurisdictional defense for various clients and served as part of national coordinating counsel teams.

In addition to her traditional trial work, Erin represents toxic tort clients at the appellate level. She has briefed before the Pennsylvania Supreme Court in opposition of a further appeal and argued before both The Superior Court of Pennsylvania and the Appellate Division of the Supreme Court, First Judicial Department in New York.

Erin has spent her entire legal career defending clients in notoriously difficult venues—a background that has helped increase her focus on clients’ business considerations. She knows that clients don’t always have the same goals in litigation, and different organizations may have higher levels of concern about public relations. Erin aims to offer legal strategies that make sense in the larger business context, and she understands that ultimately, legal decisions are business decisions.

Known for her quick response rate and availability to clients, Erin prioritizes staying on top of relevant case law and other developments in her jurisdictions. Clients appreciate her dedication to keeping them informed not only about their own cases, but about related verdicts and changes that have the potential to affect their own litigation.

Experience
  • Handled day-to-day defense of toxic tort, products liability, and environmental matters venued in New York, New Jersey, and Pennsylvania, including regular court appearances; deposing fact and expert witnesses; drafting various briefings, motions, and memoranda; and negotiating discovery disputes and early case resolution to satisfy each client's particularized objectives, for wide array of product manufacturers and suppliers from Fortune 500 companies to local and regional businesses.
  • Briefed and orally argued appeal of forum non conveniens issue before The Superior Court of Pennsylvania resulting in a win for the defense, and subsequently opposed a petition for reargument en banc, again resulting in a win for the defense (Weatherly v. Beckman Coulter, Inc., No. 2313 EDA 2021, 2023 Pa. Super. Unpub. LEXIS 1379 (June 6, 2023)).
  • Conducted over 100 discovery depositions of plaintiffs, fact witnesses, and expert witnesses in products liability matters defending product manufacturers, suppliers, raw materials brokers, and contractors.
  • Coordinated the multijurisdictional defense of several clients, which involved consistent communication with the client, local counsel, and various insurance carriers.
  • Second chair trial experience in six cases defending claims of asbestos exposure from product manufacturers and suppliers.
  • Briefed and orally argued appeal of summary judgment denial on behalf of product manufacturer before the Appellate Division of the Supreme Court, First Judicial Department.
Outside the Office

With two young boys at home, Erin devotes most of her free time to her family. Her kids are still at an age where even a trip to the grocery store is an adventure—and a challenge!
