Overview

Gabriel represents clients in insolvency and bankruptcy matters, with particular experience in the agricultural and food systems industries.

Gabriel guides creditors, debtors, and other interested parties through complex insolvency matters while keeping the client’s end goal in mind. Gabriel has represented traditional bank lenders, non-traditional lenders, and other creditors in loan workouts, creditors’ rights, commercial bankruptcy proceedings, nonjudicial Article 9 foreclosures, and receivership proceedings. He leverages his creditor-side work to advise businesses in financial distress and in other transactions.

In addition to insolvency and bankruptcy matters, Gabriel’s experience includes commercial real estate transactions, asset purchase/sale transactions, and serving as the first point of legal counsel for companies without in-house legal teams.

Gabriel’s goal is to resolve disputes efficiently and provide candid advice to clients about their options. Experience
  • Represented agricultural lenders in replevin, foreclosure of security interest, and breach of contract actions across Kansas and Missouri.
  • Litigated and collected secured and unsecured promissory notes and guaranties, including commercial real estate foreclosures involving a variety of properties.
  • Obtained appointment of receiver in foreclosure action on historic Brotherhood Bank Building in downtown Kansas City, Kansas.
  • Represented secured and unsecured creditors in Chapter 7, 11, 12, and 13 bankruptcies.
  • Negotiated and drafted forbearance agreements and refinancings involving loans secured by commercial real estate and personal property.
  • Coordinated pre-litigation, non-judicial UCC Article 9 foreclosure sales of collateral.
  • Represented clients in commercial real estate acquisition, disposition, leasing, and financing matters.
  • Litigated real estate disputes related to leasing, acquisition/disposition, and other commercial landlord-tenant disputes, as well as other complex commercial matters and business torts.
  • Served as first point of outside counsel for diverse array of small businesses, including representation in the purchase and sale of company assets, vendor contract negotiation, and corporate governance matters.
Outside the Office

Outside the office, Gabriel is an avid golfer and fitness enthusiast. However, he is at his happiest when spending time with his wife and young daughter.

Community Leadership

Gabriel has participated in J-LEAD (Jewish Leadership, Education, Action and Development), a charitable “Shark Tank” style grant program dedicated to making an impact in the Jewish community.
