Cody fights for clients in complex commercial litigation.

A fierce litigator with a diverse commercial practice, Cody represents businesses of all sizes in a wide array of matters that include contract and shareholder disputes; oil and gas litigation; products liability; construction, leasing, and real estate disputes; and other business litigation disputes. He has argued cases in both state and federal court and on appeal and has tried to verdict—serving as first chair and obtaining a directed verdict as early as his second year as an attorney.

Cody often takes a leading role in cases, drafting all pleadings, handling depositions, corresponding with both clients and opposing counsel, and taking a central role in trial preparation. His competitive nature makes him a perfect fit for litigation: he loves nothing more than achieving a win for clients, and he also understands that a win may look different in different situations. Cody’s goal is to achieve the client’s preferred result, whether that’s a victory at trial or an efficient, favorable settlement.

Known for his analytical mind, Cody tends to spot the best argument early on in a case—and then targets his discovery work towards that argument. He also has a gift for thinking quickly on his feet, modifying strategies as necessary in a courtroom. A results-oriented professional with a strong work ethic, Cody is always ready to deliver for clients.

  • Obtained jury verdict for breach of contract and fraud with $1.25M in damages awarded.
  • Obtained full defense verdict for real estate developer in dispute over a right of first refusal, resulting in the client receiving a $950K fee.
  • Successfully briefed and argued Rule 91a motion in breach of fiduciary duty case in the Fort Worth Business Court.
  • Successfully overturned summary judgment on appeal in El Paso Court of Appeals in dispute over minerals interests.
Outside the Office

Cody loves sports and the outdoors.

As a former student athlete who played baseball for Davidson College, Cody is a fan of anything sports-related, including fantasy sports, and especially enjoys golfing and playing basketball. He spends as much time as possible outside, and he and his wife, Noelle, like to plan their vacations around hiking.

Cody and Noelle also enjoy playing with and walking their Pit Bull, Lila.
