Overview

Caleb helps clients work through an unfamiliar process – bankruptcy – to maximize their result and return. 

A member of the firm’s Insolvency and Commercial Bankruptcy group, Caleb assists clients in corporate and debt reorganizations and distressed mergers and acquisitions. He represents regional and national banks, landlords, commercial lenders and other creditors in commercial bankruptcy cases, loan workouts, foreclosures and lien priority disputes. Caleb also has experience administering all aspects of the claims process, including drafting objections and stipulations, collecting data, negotiating settlements, and preparing for contested hearings.

Caleb has deep experience representing commercial landlords in large retail bankruptcies. He has represented landlord interests on a wide variety of issues in nearly every large retail filing, including Sears, Aeropostale, RadioShack, Pacific Sunwear, The Wet Seal, The Limited, Payless Shoesource and Gymboree.  

Caleb also practices in all aspects of commercial litigation. He has experience representing clients in the banking, healthcare, manufacturing and insurance industries.

  • Representing creditors committee in successful bankruptcy sale and Chapter 11 plan of liquidation related to manufacturing company, with over $25 million annual sales pre-petition.
  • Represented one of nation's largest REITs in national "big box" retail bankruptcy, protecting clients' interests, including negotiating the preservation of easement rights in 363 sale.
  • Represented multiple landlords in national retail Chapter 11 bankruptcy, including filing claims with 100 percent expected recovery for general unsecured creditors and collecting attorneys' fees from debtor in regard to lease cure and assumption.
  • Represented national REIT in chain-wide retail leasing restructure and workout.
  • Represented national banking company in insolvency matters, including bankruptcy of trucking operations with more than millions in total claims.
  • Represented national grocery store supplier in 503(b)(9) claims objection proceedings with favorable results.
  • Represented national storage affiliate in eviction and collection proceedings with favorable results.
  • Represented national shopping center in successful tenant eviction and collection proceedings.
  • Obtained summary judgment for healthcare services client in U.S. District Court, Eastern District of Tennessee, which ruled in favor of our client, interpreting contract obligating six affiliated entities to be joint and severally liable for debt incurred by an individual entity.

Outside the Office

With two young daughters, Caleb says his hobbies generally revolve around chasing them. When he can steal time for himself, he enjoys fly fishing on the Hiawassee River. A native of Cleveland, Ohio, Caleb also is an ever-loyal fan of the Cleveland Browns, Cavaliers and Indians.
