Thomas is strategic and pragmatic commercial litigator.

For more than a decade, Thomas has successfully handled, at both the state and federal level, product liability, mass tort, construction defect, personal injury, and other commercial disputes. Thomas has also effectively handled all phases of appellate matters, some of which have received national attention given their precedent-setting value.

Over the past few years, Thomas has served as outside general liability counsel for a national restaurant chain, overseeing the company’s general litigation portfolio. He continues to serve as lead counsel for this client - primarily in the areas of personal injury and premises liability – actively defending the client in high-exposure matters. In this capacity, Thomas addresses contract disputes between commercial entities, takes and defends party and expert depositions, develops and drafts dispositive motions, attends mediation, and directly handles all communications intended to achieve a final, cost-effective resolution of the underlying matter.    

Thomas embraces the fact that he works in the service industry, meaning he places an emphasis on creating a client-centric environment driven by assertive communication and the development of a tailored legal strategy.

  • Briefed and presented oral argument to the Utah Supreme Court, resulting in a favorable appellate opinion.
  • Successfully resolved construction defect matters through informal settlement negotiations and at mediation.
  • Drafted successful motions for summary judgment based on the Colorado Construction Defect Action Reform Act (CDARA).
  • Drafted appellate brief filed in Colorado Court of Appeals resulting in affirmation of trial court's dismissal of claims against individual clients.
  • Managed product liability portfolio involving 300-plus medical device cases filed in multidistrict litigation (MDL) proceedings.
Outside the Office

Thomas lives in the foothills of the Rockies just outside of Denver and aims to spend as much time as possible outdoors, whether hiking, skiing, or just getting some fresh air with his dog, Madison, who is usually leading the way.
