Husch Blackwell Assists Client Infigen Energy in Successful Settlement of Wind Turbine and Insurance Litigation

For the past 20 months, Husch Blackwell has worked as lead litigation counsel for renewable energy business Infigen Energy in legal proceedings with Gamesa Wind US LLC, one of the largest wind turbine manufacturers in the world, and with Lloyd’s of London, Infigen’s insurer. The litigation focused on assigning responsibility for the cost to repair or replace wind turbine blades at five of Infigen’s wind farms. With assistance from the Husch Blackwell team, Infigen recently reached a successful global resolution of its disputes with Gamesa and Lloyd’s. Under the settlement agreement, Gamesa will provide turbine maintenance services, replacement components and warranties for Gamesa-manufactured turbines purchased by Infigen until June 14, 2028. Infigen has interests in 24 wind farms across the United States and Australia. 

Attorneys from seven Husch Blackwell offices – Chattanooga, Tenn.; Chicago, Ill.; Kansas City, Mo.; Memphis, Tenn.; Omaha, Neb.; St. Louis, Mo.; and Washington, D.C. – assisted Infigen on this matter. The team was led by Partners Mike GatjeBrian Waagner and Tom Dee, with Associate Steve Neeley providing a particularly significant contribution.

“This settlement and the new Warranty and Maintenance Agreements with Gamesa are the outcome of successful commercial negotiations that have reduced risk to Infigen,” said Infigen Energy’s Managing Director Miles George.
