Experience
  • Assisted hospitals with respect to Medicaid and Medicare reimbursement issues.
  • Represented healthcare entities, including hospitals, physicians and other providers in connection with complex business transactions.
  • Advised healthcare providers in connection with state and federal legislative and regulatory initiatives related to the healthcare industry and their potential ramifications.
  • Developed and implemented policies and procedures to ensure that healthcare providers complied with state and federal requirements related to Medicaid, Medicare, charity-care reporting, the Emergency Medical Treatment and Active Labor Act (EMTALA), the Health Insurance Portability and Accountability Act (HIPAA) and its administrative simplification regulations, discounting, fraud and abuse, and other state and federal statutes and regulations.
  • Drafted and negotiated on behalf of hospitals, doctors and other providers managed-care contracts and other types of payment arrangements.
  • Represented providers in litigation to enforce payment obligations under managed-care contracts and other types of payment arrangements.
  • Represented healthcare providers in government investigations and ensued administrative and civil actions, defense of whistle blower actions, internal investigations, claims audits, business operations reviews, and establishing and maintaining compliance programs and processes.
  • Drafted and interpreted medical staff bylaws.
  • Advised nonprofit charitable organizations in regard to corporate and compliance issues related to the maintenance of their tax-exempt status.
