Eric uses his deep knowledge of Medicaid and Medicare reimbursement, compliance and regulatory matters to help healthcare clients find the answers they need.

As the leader of the firm’s Healthcare Regulatory & Compliance Counseling team, Eric advises healthcare providers nationwide on state and federal regulatory and operations issues, including requirements related to reimbursement, fraud and abuse, licensure and other matters. Eric is especially well-versed in Medicaid supplemental payment programs.

He represents clients in connection with Medicaid payment initiatives, government and internal investigations, and business operations reviews, and he helps them establish compliance programs and processes. Eric also advises clients on complex business transactions and affiliation agreements between hospitals and medical schools.

Featured Experience

New Medicaid Program Offsets Hospitals' Expenses

Eric represented private hospital groups in Wyoming in creating a Medicaid supplemental payment program. He helped determine the amount of funds the hospitals were entitled to receive, developed a lobbying strategy to help pass a provider assessment statute through the Wyoming Legislature and helped draft a Medicaid state plan amendment to initiate the payment mechanism. The project generated an additional $10 million in Medicaid supplemental payments to help offset costs in treating Medicaid patients.


Additional Experience
  • Advised healthcare providers in connection with state and federal requirements related to Medicaid and Medicare licensure, charity-care reporting, Emergency Medical Treatment and Active Labor Act (EMTALA), Health Insurance Portability and Accountability Act (HIPAA) and its administrative simplification regulations. Also advised providers concerning discounting, fraud and abuse, and other state and federal statutes and regulations, including implementing policies and procedures.
  • Represented healthcare providers in government investigations and ensued administrative and civil actions, defense of whistle blower actions, internal investigations, claims audits, business operations reviews, and establishing and maintaining compliance programs and processes.
  • Drafted and interpreted medical staff bylaws.
  • Advised nonprofit charitable organizations in regard to corporate and compliance issues related to the maintenance of their tax-exempt status.
  • Represented hospitals in agreement with their affiliated medical schools to develop residency programs and innovative clinical operations.
  • Assisted hospitals with respect to Medicaid and Medicare reimbursement issues.
  • Drafted and negotiated on behalf of hospitals, doctors and other providers managed-care contracts and other types of payment arrangements.
  • Represented providers in litigation to enforce payment obligations under managed-care contracts and other types of payment arrangements.
Outside the Office

Eric likes to cheer on the Texas Longhorns and spend time outdoors with his family.

He and his wife play tennis, and the family likes to travel and go on hikes. Eric also enjoys fishing and hunting.
