  • Represent national and regional financial institutions in large syndicated, participated and single bank construction, acquisition and refinance loan transactions for commercial real estate properties across the United States.
  • Represent national waterpark developers in acquisition, development, and re-development of waterpark resort hotel facilities across the United States.
  • Represented a professional football team in negotiating and documenting one of the largest stadium naming rights deals in the nation, as well as in acquiring land for the development of the team's headquarters and practice facility.
  • Represent lender in construction loan to large national developer, facilitating new six-story, ~100,000 sq ft commercial office building in Tempe, Arizona.

Commercial & Industrial Finance

  • Served as exclusive counsel to publicly traded national financial institution to document all middle market C&I and CRE loan amendments as a result of the COVID-19 pandemic.
  • Represent lender in full refinance and redocumentation of revolving credit line increases and term loans for cash out refinance.
  • Represent lender in financing arrangement for shareholder recapitalization secured by multiple properties in different states across the United States.
  • Represent administrative agent in club deal with revolving and term lines of credit.
  • Represent lender in multiline credit facility involving revolving and term debt to three borrowers in Houston, Texas.
  • Represent national bank in preparation of commercial and consumer loan documents for Wisconsin-based transactions, advise on PPP Loan and Main Street Lending Loan programs, and advise on national e-signature and e-notarization laws, applicability and best practices.

Ag Lending

  • Preparation of form agricultural lending documentation set for multi-national financial institution with large agriculture financing exposure.
  • Represent global financial institution in participation into $300,000,000 multi-lender, multi-tranche asset-based credit facility loan to one of the country's largest agricultural producers.
  • Represent global financial institution as administrative agent for $750,000,000 syndicated credit facility to Abu Dhabi-owned subsidiary grain processor.
  • Represent regional financial institutions and borrowers in revolving, term and other credit facilities in the agriculture and food production industries in Illinois, Wisconsin, Texas, Idaho, California, Washington, Oregon and other U.S. states.
  • Represent national and regional financial institutions in agriculture loan workouts, insolvency, restructuring and bankruptcy proceedings.

  • Represent administrative agent in construction loan for 272-unit multifamily project in Madison, Wisconsin with national, Chicago-based developer.
  • Represent lender in acquisition loan to large national investor for ~337-unit multifamily property in Forney, Texas.
  • Represent borrowers, lenders, leverage lenders, and community development entities in new market tax credit financing transactions across the United States.
  • Represent lender in Low-Income Housing Tax Credit Loan (LIHTC) to multifamily developer for construction and development of 40-unit, Section 42 housing development located in New Glarus, Wisconsin.
  • Represent lender in construction loan for transformative mixed-use development of 95-unit apartment building with 17,155 sq ft commercial retail tower in Walker's Point area of Milwaukee, Wisconsin.

Long-time client Associated Banc-Corp approached our team in late March 2020 regarding the potential sale of Associated Benefits & Risk Consulting (ABRC). We had assisted Associated in building the unit over the previous decade, having worked on numerous acquisitions that turned ABRC into the 36th largest broker of U.S. business providing employee benefits, retirement plans, compliance, business insurance, risk management and individual insurance solutions. Derek is serious about meat and flames.

He barbecues competitively on the Kansas City Barbeque Society (KCBS) circuit in the Midwest and in other non-sanctioned competitions. He is also a founding board member of the Wisconsin BBQ Posse Inc., a 501(c)(3) nonprofit organization that publicizes food sport, fosters partnerships and mentors novice competitors.
