Cormac Connor will moderate "Trends in Procurement Enforcement: Issues for Contractors to Watch," for American Bar Association's Public Procurement Symposium on Friday, October 14, 2022.

In recent years, the U.S. DOJ has prioritized the enforcement of competition, award, and performance statutes related to government procurements.  It created the Procurement Collusion Strike Force, an interagency partnership focused on antitrust crimes and related schemes that target government procurements, grants, and program funding.  In addition, the DOJ has prioritized the enforcement of the False Claims Act and recently launched the Civil Cyber-Fraud Initiative to combat cybersecurity-related fraud by government contractors and grant recipients.  The FCA also remains a key enforcement tool that has implications for contractors dealing with all levels of government.  For contractors, these efforts highlight the need to develop and maintain vigilant contracting compliance programs to ensure that they do not run afoul of procurement-related statutes, regulations, rules, and contractual provisions, including cybersecurity obligations. This Panel of Government enforcement attorneys will discuss:

  • Updates on PCSF and Antitrust Division efforts related to procurement
  • Updates on CCFI and Civil Division efforts related to procurement
  • Focus areas and trends in cybersecurity enforcement and False Claims Act litigation, including for state and local projects funded with federal dollars
  • Best practices for contractors and grant recipients to reduce risk of procurement enforcement actions
