The Department of Labor recently issued its long-anticipated final rule regarding the Fair Labor Standards Act (FLSA) overtime exemptions. The rule, which will go into effect January 1, 2020, includes: 

  • An increase in the standard salary threshold for “white-collar” exemptions
  • An increase in the “highly compensated exemption” total annual compensation threshold
  • Guidance regarding the use of nondiscretionary bonus and incentive payments to satisfy salary thresholds
