Mediation Is Key to Condo Association's Recovery

Case Study

A condominium association filed a notice of arbitration for $5.5 million against the condo developer over construction defects, supported by two engineering reports. In its response, the developer admitted no liability and advised it had no assets. Before discovery made the process very expensive, the parties agreed to mediate.

In an all-day mediation, the Husch Blackwell team suggested creative strategies for maximizing payments from the developer to the association.
