Situation
A liability insurer entangled in years of coverage disputes in multiple jurisdictions faced exposure for judgments in excess of $35 million against its insureds—along with potential punitive damages. After failed mediations and multiple state and federal appeals, the plaintiff initiated garnishment proceedings against the insurer.
Result
We significantly reduced the insurer’s exposure in the garnishment proceeding and obtained summary judgment in federal court. We arranged a third mediation in the context of the garnishment proceeding and secured settlement for substantially less than plaintiff’s demands.
