Interest/Penalties (Private): N/A

Owner to Prime Contractor (Public): Unless otherwise provided by contract, 30 days after receipt of invoice or receipt of services, whichever is later, for projects with the state and 45 days after invoice or receipt of services, whichever is later, for projects with localities municipalities.

Prime Contractor to Subcontractor (Public): 7 days after receipt of payment from owner.

Interest/Penalties (Public): Interest at a rate of 1% per month unless otherwise agreed by contract.

Pay-If-Paid Permissible: No.

Special Notes: Notice of defects that would prevent timely payment must be sent within 15 days after receipt of the invoice or the defective goods or services.
