Spoliation of Evidence Results in Dismissal of Class Action

Situation

A putative class action alleged improprieties by pharmacy benefit managers that affected independent drug stores and the general public. The case wound its way through the courts for 15 years, presenting issues that were addressed multiple times by the Ninth Circuit Court of Appeals, and once on a certified question by the California Supreme Court. 

Result

In defense of our pharmacy benefit manager client, Husch Blackwell litigators argued that the plaintiffs destroyed evidence relevant to their substantive claims. The District Court agreed, and it dismissed the case with prejudice.
