Oregon: State-by-State Summary of Prompt Payment

Oregon

Owner to Prime Contractor (Private): 14 days after receipt of invoice. Final payment due 7 days after approval of the work. Late payment allowed in limited circumstances using statutorily required language.

Prime Contractor to Subcontractor (Private): 7 days after receipt of payment from owner.

Interest/Penalties (Private): Interest at the higher rate of 1.5% per month or as agreed by contract. Reasonable attorneys’ fees and costs awarded to prevailing party.  

Owner to Prime Contractor (Public): 30 days after receipt of invoice. Final payment due 30 days after acceptance of the work.

Prime Contractor to Subcontractor (Public): 10 days after receipt of payment from owner.

Interest/Penalties (Public): Progress payment: Interest at the rate set forth by statute, not to exceed 30%; final payment: interest at a rate of 1.5% per month.

Pay-If-Paid Permissible: Yes.
