Owner to Prime Contractor (Private): Unless otherwise agreed by contract, 28 days after receipt of invoice.

Prime Contractor to Subcontractor (Private): Unless otherwise agreed by contract, 10 days after receipt of payment from owner.

Interest/Penalties (Private): N/A

Owner to Prime Contractor (Public): For contracts over $25,000, 30 days after receipt of invoice.

Prime Contractor to Subcontractor (Public): 10 days after receipt of payment from owner.

Interest/Penalties (Public): Prime contractor: interest at the statutory rate; Subcontractor: interest at a rate of 1.5% per month.

Pay-If-Paid Permissible: Yes.
