In addition to the recent rulemaking regarding waters regulated under the Clean Water Act, the Supreme Court answered whether groundwater was entirely beyond the Act’s jurisdictional reach, and a federal court partially enjoined an Army Corps nationwide permit (NWP12) commonly used for utility lines.
