Provider's use of electronic health records (EHRs) has increased markedly over the past five years due to implementation of the Affordable Care Act’s “meaningful use” EHR Incentive Program, as well as the need to share data for purposes of value-based purchasing. Although the use of EHRs presents incredible opportunities to enhance quality of care and increase provider reimbursements, it also poses formidable legal challenges that providers must be prepared to address.
