Over the past few years, CMS has dramatically expanded Medicaid reimbursement opportunities through a variety of state directed payment programs, while continuing to support other supplemental payments. Simultaneously, CMS has escalated regulatory action and litigation to limit states’ use of certain mechanisms to finance the non-federal share of Medicaid payments. Now, Congress has taken substantial action through the One Big Beautiful Bill Act to alter the parameters and rules governing these payment programs. This presentation will discuss these emerging issues, payment program opportunities, and the changes implemented through the OBBBA, with particular focus on the impact in Pennsylvania and New Jersey. The presentation will contribute to the competency of Pennsylvania attorneys navigating Medicaid laws and regulations in the wake of the OBBBA, which dramatically alters the regulatory guidelines of the Medicaid program.
