Amicus Brief: Michels v. Lyons

Along with the Cato Institute’s Ilya Shapiro, Husch Blackwell’s Joseph Diedrich has co-authored an amicus brief in Michels v. Lyons, a case currently pending before the Supreme Court of Wisconsin involving the scope of constitutional rights in the family context.

Drawing on a variety of legal, historic, and scholarly sources, the brief urges the Court to decide the case consistently with the original public meaning of the Fourteenth Amendment. In particular, the brief discusses the Privileges or Immunities Clause, which despite having fallen into disuse was originally understood to be a primary mechanism for limiting state infringement of substantive rights.
