New Jersey: State-by-State Summary of Prompt Payment

New Jersey

Owner to Prime Contractor (Private): 30 days after the billing date set forth in the contract.

Prime Contractor to Subcontractor (Private): Unless otherwise provided by contract, 10 days after receipt of payment from owner.

Interest/Penalties (Private): Interest at the prime rate plus 1%. Reasonable attorneys’ fees and costs awarded to prevailing party.

Owner to Prime Contractor (Public): 30 days after the billing date set forth in the contract. For municipalities and counties, contracts exceeding $100,000 total must make payment at least once per month unless the contractor agrees to deposit bonds.

Prime Contractor to Subcontractor (Public): Unless otherwise provided by contract, 10 days after receipt of payment from owner.

Interest/Penalties (Public): Interest at the prime rate plus 1%. Reasonable attorneys’ fees and costs awarded to prevailing party.

Pay-If-Paid Permissible: Yes.
