Nevada: State-by-State Summary of Prompt Payment

Owner to Prime Contractor (Private): Unless otherwise agreed by contract, 21 days receipt of invoice. Final payment due 30 days after substantial completion/occupancy

Prime Contractor to Subcontractor (Private): 10 days after receipt of payment from owner unless an earlier time period is required by contract. If the contract is silent on timing for payment, payment is due on the earlier of 30 days after receipt of invoice and 10 days after receipt of payment from owner.

Interest/Penalties (Private): Interest at the prime rate determined by the largest bank in the state plus 4% unless a higher rate is required by contract. Party seeking payment is entitled to recover reasonable costs and attorney fees.

Owner to Prime Contractor (Public): 30 days after receipt of invoice unless an earlier time period is required by contract. Final payment due 30 days after occupancy/use.

Prime Contractor to Subcontractor (Public): 10 days after receipt of payment from owner.

Interest/Penalties (Public): Prime contractor: interest at the highest 90-day deposit rate at the beginning of the most recent quarter; Subcontractors: interest at the lowest daily prime rate at the three largest national financial institutions plus 2%. Party seeking payment is entitled to recover reasonable costs and attorney fees.

Pay-If-Paid Permissible: No.

Special Notes: Public contract provisions don’t apply to projects involving the Department of Transportation.
