Nebraska: State-by-State Summary of Prompt Payment

Nebraska

Owner to Prime Contractor (Private): 30 days after receipt of invoice.

Prime Contractor to Subcontractor (Private): 10 days after receipt of payment from Owner.

Interest/Penalties (Private): Interest at a rate of 1% per month. Attorneys’ fees awarded to prevailing party.

Owner to Prime Contractor (Public): 30 days after receipt of invoice. For State projects, payment is due 45 days after the later of receipt of the services or receipt of invoice.

Prime Contractor to Subcontractor (Public): 10 days after receipt of payment from owner. Not applicable to State projects.

Interest/Penalties (Public): Interest at a rate of 1% per month. For State projects, interest at the rate provided by statute.

Pay-If-Paid Permissible: Yes.

Special Notes: A party is only obligated to pay interest if the contractor notifies the payor of their statutory obligations.
