Missouri: State-by-State Summary of Prompt Payment

Owner to Prime Contractor (Private): Payment is due per the terms of the contract.

Prime Contractor to Subcontractor (Private): Payment is due per the terms of the contract.

Interest/Penalties (Private): Interest at a rate of 1.5% per month. Attorneys’ fees awarded to prevailing party.

Owner to Prime Contractor (Public): Payment due at least every 30 days. Final payment due 30 days after project completion.

Prime Contractor to Subcontractor (Public): 15 days after receipt of payment from owner.

Interest/Penalties (Public): Interest at a rate of 1.5% per month. Attorneys’ fees awarded to prevailing party in court’s discretion.

Pay-If-Paid Permissible: Yes, if clearly stated in the contract, but clause cannot be used as a defense to lien claims.
