Minnesota: State-by-State Summary of Prompt Payment

Owner to Prime Contractor (Private): Monthly unless otherwise provided in the contract. .

Prime Contractor to Subcontractor (Private): 10 days after receiving payment from the owner.

Interest/Penalties (Private): Interest at a rate of 1.5% per month. Party owed interest is entitled to attorneys’ fees if it prevails.

Owner to Prime Contractor (Public): Monthly unless otherwise provided in the contract.

Prime Contractor to Subcontractor (Public): 10 days after receiving payment from the owner.

Interest/Penalties (Public): Subcontractors are entitled to interest at a rate of 1.5% per month. Subcontractor is entitled to attorneys’ fees if it prevails.
