Definition of “Public Works”: A structure or work, including a bridge, building, ditch, road, alley, waterwork, or sewage disposal plant, that is constructed for public use or benefit; or is paid for wholly or partly by public money. Excludes projects capital projects that receive state funds as local House of Delegates or Senate initiatives from the annual state capital budget.

Categories of Construction Covered: Building Construction and Highway Construction

Source of Funds: Applies if the contract is for $500,000 or more—or, $250,000 or more—and either (1) the awarding public body is an instrumentality of the state or a unit of state government and there is any state funding or (2) the awarding public body is another agency, political subdivision, entity, or person and at least 25% of the money is state funding.
