Louisiana: State-by-State Summary of Prompt Payment

Louisiana

Owner to Prime Contractor (Private): 10 days from receipt of invoice.

Prime Contractor to Subcontractor (Private): 14 days from receipt of payment from owner.

Interest/Penalties (Private): Interest at a rate of 0.5% per day, but the total interest may not exceed 15% of the amount due, plus reasonable attorney fees if payment was withheld without reasonable cause.

Owner to Prime Contractor (Public): 45 days follow receipt of certified request for payment.

Prime Contractor to Subcontractor (Public): 14 days from receipt of payment from owner.

Interest/Penalties (Public): Interest at a rate of 0.5% per day, not to exceed 15% of the amount due, plus reasonable attorney fees if payment was withheld without reasonable cause.

Pay-If-Paid Permissible: Yes.

Special Notes: Contractor must share interest payments received from owner proportionately with its subcontractors within 10 business days of receipt.
