Kentucky: State-by-State Summary of Prompt Payment

Kentucky

Owner to Prime Contractor (Private): 30 business days after receipt of invoice.

Prime Contractor to Subcontractor (Private): 15 business days after receipt of payment from owner.

Interest/Penalties (Private): Interest at a rate of 12% per annum. Attorney’s fees are awarded to prevailing party if the nonpaying party acted in bad faith.

Owner to Prime Contractor (Public): 30 business days after receipt of invoice, except that postsecondary institutions and department of education have 45 business days to make payment.

Prime Contractor to Subcontractor (Public): 15 business days of receipt of payment from owner.

Interest/Penalties (Public): Interest at a rate of 12% per annum. Attorney’s fees are awarded to prevailing party if the nonpaying party acted in bad faith.

Pay-If-Paid Permissible: Yes.

Special Notes: Contractor must notify owner of nonpayment 25 business days following submission.
