Intellectual Property Attorney Joins Chicago Husch Blackwell Healthcare Team

Husch Blackwell welcomes Partner Kelly J. Eberspecher to its Chicago office. Eberspecher joins the firm’s Healthcare, Life Sciences & Education industry team, having previously practiced at a large Chicago-based IP firm, where he was the co-chair of its Biotechnology and Pharmaceutical Practice Group.

Eberspecher has substantial experience in both jury and bench trials and routinely serves as lead counsel in contentious proceedings. Eberspecher’s litigation practice focuses on pharmaceuticals and medical devices. Pharmaceutical litigation arising under the Drug Price Competition and Patent Term Restoration Act, colloquially known as the “Hatch-Waxman Act,” is a significant part of his practice. The Hatch-Waxman Act was enacted, in part, to streamline generic drug approvals and associated patent litigation.

He has extensive experience litigating cases involving chemical, mechanical and electrical technologies. Also, Eberspecher has litigated several matters arising under the Lanham Act (the primary federal trademark statute), as well as cases involving trade secrets and copyrights.

Recognized as a leader in his field, Eberspecher serves as an instructor for the National Institute of Trial Advocacy (NITA®). He is the vice chair of the Economics of the Profession Committee for the American Bar Association Intellectual Property section and is recognized as a leading practitioner in his field, with honors such as being named a Leading Intellectual Property Lawyer, Leading Lawyers Network. Eberspecher is a veteran of the U.S. Navy where he served as a Navy SEAL, special operations forces.

Eberspecher received his J.D. from Indiana University of Michigan Law School (1998). Prior to attending law school, Eberspecher received his B.S. in Biology, from the University of Wyoming (1994) with a minor in Chemistry.
