Definition of “Public Works”: “Public work” means any project, including development of any housing and development, construction, renovation, and maintenance related to refurbishment of any real or personal property, where the funds or resources required or used to undertake the project are to any extent derived, either directly or indirectly, from public revenues of the State or any county, or from the sale of securities or bonds whose interest or dividends are exempt from state or federal taxes. “Public work” also includes a construction contract between private persons if more than [50%] of the assignable square feet of a project is leased or assigned for use by the State, any county, or any agency of the State or any county, whether or not the property is privately owned.

Source of Funds: Hawaii prevailing wage laws apply to every public works project contract exceeding $2,000 in overall construction value, where the State of Hawaii or any other subdivision agency is a party thereto.

Wage rate schedules shall be regularly issued on or about February 15 and September 15 of each year, however, the Hawaii Department of Labor and Industrial Relations may issue additional wage rate schedules are issued as needed. Any increases in prevailing wage rates shall be applicable during the performance of a contract.
