Florida: State-by-State Summary of Prompt Payment

Owner to Prime Contractor (Private): N/A

Prime Contractor to Subcontractor (Private): Unless otherwise agreed upon by contract, 30 days after receipt of payment from the owner.

Interest/Penalties (Private): Interest at the rate specified in the contract or the rate specified in Fla. Stat. § 55.03, whichever is higher.

Owner to Prime Contractor (Public): 10 days after invoice is approved by the agency. Invoices must be approved no later than 20 days after receipt.

Prime Contractor to Subcontractor (Public): 10 days after receipt of payment from owner.

Interest/Penalties (Public): Interest at a rate of 1% per month. Attorneys’ fees and court costs will be awarded if payment was unreasonably withheld.

Pay-If-Paid Permissible: Yes.
