Definition of “Public Works”: A “public works project” is defined by Delaware law as construction, reconstruction, demolition, alteration and repair work and maintenance work of and on a public building, paid for, with funds of and from the State of Delaware, a state agency, a public school district, of and from the United States government, or any department or agency thereof.

Source of Funds: Delaware prevailing wage rates shall be paid on new construction projects costing more than $500,000.
Delaware prevailing wage rates shall also be paid on alteration, repair, renovation, rehabilitation, demolition or reconstruction projects costing more than $45,000.
For a project to be covered by the law, the state of Delaware or any subdivision thereof shall be a party to the publics works contract, and, the state of Delaware shall have appropriated all or any part of the funds.
