Situation
A manufacturing company hired a firm to design a new campus headquarters including an office building, distribution center and museum budgeted to cost $32 million. The design firm failed to consider the economic consequences of its aesthetic choices and ran afoul of the city’s design constraints, causing anticipated construction costs to balloon to more than $57 million.
Result
We represented the manufacturing company in extensive negotiations to successfully resolve delay, defect and payment disputes with the general contractor associated with the design issues, as well as the contractor’s performance.
