Situation
Husch Blackwell’s Intellectual Property team defended a global leader in baby and children’s products that was charged with patent infringement in federal court in California. The team also asserted infringement of a patent of the same client against a competitor in federal court in Texas.
Result
In defense of the client, we successfully invalidated all claims of the patent in suit by filing and winning an inter partes review at the Patent Trial and Appeal Board (PTAB). In Texas, we successfully defended all claims of the patent in a companion inter partes at the PTAB brought by the competitor. No claims were invalidated, an infrequent outcome at the PTAB.
