Situation
Approximately 275 families in San Martin, Calif., sued for damages resulting from contaminated groundwater allegedly originating from our client’s former manufacturing facility. The defense required the presentation of expert testimony in hydrogeology and groundwater modeling, toxicology, pharmacology, epidemiology, econometric modeling of alleged property price impacts, history of analytical chemistry techniques, and human health risk assessment.
Result
After a four-week jury trial, we obtained a defense verdict on the claims of four bellwether cases. Shortly after the verdicts, the remaining cases settled for nuisance value.
