Situation
Tri-County Electric Cooperative sought to recover transmission costs on assets used to provide interstate service in the Texas/Oklahoma panhandle. The facilities are operated by Southwest Power Pool Inc., a FERC-regulated RTO. Tri-County has been collecting under a formula rate mechanism that has been included in SPP’s tariff and was subject to regulation at the federal level for the first time.
Result
Over strong opposition, our client secured more than $2 million in new electric transmission rates in a precedent-setting FERC rate proceeding.
