Breed Association Wins Post-Grant Review

Situation

Our client, a cattle breed association, was sued for allegedly infringing several patents covering online systems used to generate relative market value of livestock based, in part, on genetic merit data. Our client was also accused of misappropriating certain information of the patent holder.

Result

We obtained a dismissal of the infringement lawsuit and then filed for and obtained post-grant review of the asserted patents with the U.S. Patent and Trademark Office's Patent Trial and Appeal Board (PTAB), the first ever granted under this new method of challenging the validity of patents. The PTAB ultimately invalidated all claims of the asserted patents.
