Tyson Foods sought recovery of $393,566 in unpaid invoices from a food wholesaler that filed a Chapter 11 bankruptcy petition in Texas. Our team promptly filed a motion with the Bankruptcy Court seeking allowance of the claim under section 503(b)(9) of the Bankruptcy Code.
Result
Despite the debtor's objection, we successfully negotiated a resolution for Tyson that provides for full payment of the claim and releases Tyson from any avoidance actions that the debtor may have against it.
