Tom manages clients’ product liability risks with the goal of preventing accidents. When incidents do occur, he works to minimize exposure and keep claims from ripening into lawsuits.

Tom’s practice focuses on catastrophic product liability matters and transportation accident claims, from coordinating accident response and investigation through trial and appeals. He also handles commercial litigation of large, complex cargo claims and works on toxic tort asbestos cases.

Protecting clients’ interests may mean litigating on their behalf, and Tom vigorously defends these cases at trial. With more than 20 years of experience, Tom has litigated as many as 35 cases in more than 20 states and numerous federal courts.

Jury Found No Damages in Defective Vehicle Maintenance and Repair Case

A large U.S. environmental services company was sued by a plaintiff who claimed he was severely injured when a recycling truck picked up a dumpster at the plaintiff’s workplace. The plaintiff alleged defective maintenance and repair of client’s vehicle. In litigating the case, Tom was particularly persuasive in getting the plaintiff’s liability expert struck from the trial and avoiding jury instruction on the destruction of records pre-suit. The jury found no defect with the vehicle, and the plaintiff recovered only a fraction of the amount claimed for medical expenses.

  • Persuaded federal court to dismiss claim for disability benefits brought by truck driver who suffered catastrophic stroke for failing to comply with statutory notice requirements. Same court later dismissed refiled suit by the same plaintiff on statute of limitations grounds.
  • Received defense verdict for motor coach company in suit brought by elderly medical transport passenger alleging injuries requiring inpatient nursing home care.
  • Obtained defense verdicts on behalf of commercial motor vehicle carriers for highway accidents.
  • Handled “emergency response” situation for commercial motor carrier involving catastrophic injuries and fatalities.
  • Handled cargo damage claims for motor carrier and shippers.

Personal Injury

  • Received defense verdict for national retailer in lawsuit brought by minor who suffered serious injuries after an allegedly defective store display collapsed.

Product Liability

  • Persuaded federal court to grant summary judgment against automatic door manufacturer after decedent’s estate brought claims alleging defective design of door components.

Business Litigation

  • Successfully resolved substantial software licensing and breach of contract claim after being retained near the end of the suit. Representation involved securing insurance payments for disputed contract claims.
  • Handled complex commercial matters involving engineering malpractice, breach of contract, intellectual property and warranty claims.

Toxic Tort

  • Managed toxic tort cases for large industrial manufacturer.

Tom likes to spend his personal time moving at high speed.

Tom has a passion for auto racing. He is involved in SCCA events throughout the Midwest.

Community Leadership

Tom is a committed volunteer at Centro Legal, which provides assistance with family law matters to families and individuals who qualify for assistance.

In addition to serving on the organization’s Board of Directors since 2007, Tom advises Centro Legal clients on parenting plans, domestic violence matters and criminal misdemeanor defense. He feels passionate that his pro bono work is for a worthy cause.
