Scott focuses his practice on regulatory and transactional healthcare law.

He counsels healthcare providers and suppliers of all sizes, from individual healthcare workers to large hospitals, national telehealth companies, healthcare industry associations and private equity firms, among others.

Scott assists healthcare providers in navigating the complex state and federal regulatory environment in which they operate, including Medicare and Medicaid requirements of participation, licensing requirements, reimbursement issues and general operational and risk-management considerations. Scott handles matters including:

  • False Claims Act

Clients value Scott’s understanding of how business intersects with healthcare. He previously served as in-house counsel to a Fortune 500 healthcare company, advising senior executives on various healthcare regulatory issues, including compliance with terms of corporate integrity agreement, healthcare fraud and abuse laws, and Medicare requirements of participation.

Seven-figure recoupments halted through negotiation.

A state Medicaid agency improperly recouped expenses from multiple home care agency provider clients. In the aggregate, these recoupments would have resulted in a multi-million dollar loss to these clients. The healthcare providers were not given an opportunity by the agency to appeal or otherwise exercise their guaranteed due process rights. Further, the agency indicated its intent to continue with these recoupments. Scott worked quickly to file numerous administrative appeals and engaged in negotiations with representatives of the state attorney general’s office to advocate on behalf of our provider clients. As a result of these efforts, the state Medicaid agency immediately halted all future recoupments and, after further negotiation, agreed to refund all amounts that had been recouped.

  • Authored request for advisory opinion from U.S. Department of Health and Human Services (HHS), Office of Inspector General regarding potential application of Anti-Kickback Statute and beneficiary inducement prohibitions to complex fact pattern.
  • Advised hospital clients on implementation of alternative models to hospital-physician integration.
  • Advised various healthcare clients on application of Americans with Disabilities Act (ADA) and Fair Housing Act (FHA) service and assistance animal requirements to various healthcare facility settings.
  • Assisted with development of sophisticated legal algorithm designed to assist nursing home operators in complying with complex federal and state reporting requirements.
  • Advised national telehealth company on healthcare regulatory considerations relating to proposed multistate expansion.
  • Advised physician organizations on participation in risk-based and value-based payment models.
  • Assisted physician practices in navigating unique regulatory issues arising from operating direct primary care and concierge medical practices.
  • Advised individual practitioners and corporate entities on state law restrictions on corporate practice of medicine and professional fee splitting.
  • Represented physicians, nursing home administrators, nurses, physical therapists and other healthcare practitioners in disciplinary proceedings before applicable state licensing boards.
  • Assisted healthcare industry associations in advocating for policy positions relating to proposed legislation.
  • Assisted private equity companies in conducting healthcare regulatory due diligence relating to complex acquisition transactions.

Scott makes the most of downtown Denver.

As a resident of the city, Scott enjoys its parks, museums, sporting events, zoo, botanic garden, live concerts (preferably blue grass), comedy shows and restaurants. Scott also likes strategy-based board games, such as chess. And he hikes and camps with his fiancée, Carolyn, and his dog, Bradley.
