Bob has a single-minded commitment to transforming complex legal issues into sound, substantive, practical advice that helps clients make the right business decisions.

Bob advises domestic and international clients in the agriculture, specialty chemical, mining, energy, product manufacturing and waste management industries on safety and health compliance, permitting and enforcement defense. Common challenges for these clients include air and water quality, land use, toxic chemical regulation, pesticide regulation, and site remediation and redevelopment.

In one striking case, he helped a Fortune 500 client develop innovative environmental protection strategies to protect water quality, tribal claims and a nesting pair of bald eagles, and successfully handled the environmental permitting for a large mineral mine on time and without any challenges to the permits.

In melding good law with good science, Bob is guided by his hands-on work as an environmental manager in private industry together with his educational background in environmental health management.

Experience
  • Represented a Fortune 500 mining and agricultural chemical processing company in connection with a multiyear Resource Conservation and Recovery Act (RCRA) enforcement investigation. Resolved the enforcement matter with no penalty and no further action required.
  • Provided project planning and environmental compliance advice in connection with the development of a major agricultural mineral mining project on federal lands, including all aspects of environmental permitting and support for National Environmental Policy Act (NEPA) review requirements.
  • Advised a Fortune 500 global manufacturer of chemical products. Following a routine RCRA compliance inspection of a large manufacturing site, U.S. Environmental Protection Agency (EPA) initiated a major investigation of all RCRA-related compliance activities and records at the site. Negotiated acceptable limitations on the production of plant records and resolution of nearly all areas of alleged violation, including many waste characterization issues, recycling issues and on-site storage and disposal issues. Resolved remaining allegations through a supplemental environmental project that eliminated the largest single source of hazardous waste in the EPA region.
  • Negotiated a favorable resolution of an EPA multimedia inspection for a Fortune 500 chemical manufacturer. EPA’s national inspection team identified more than 20 major areas of noncompliance, including RCRA waste handling and characterization issues and Clean Air Act new source review issues. Resolved all RCRA, Clean Air Act, Clean Water Act and Safe Drinking Water Act allegations with no penalty and no further action required. Resolution of the allegations confirmed many years of compliance counseling related to plant expansion to meet on-going business needs.
  • Coordinated extensive international environmental due diligence projects related to several joint ventures and acquisitions in Canada, Brazil, England, France, Germany, Portugal, Italy, Poland and China on behalf of a global manufacturer of electronic and communications materials.
  • Actively involved in federal and state rulemaking proceedings, including development of the initial federal Title V air permitting regulations, initial federal hazardous air pollutant Maximum Achievable Control Technology (MACT) regulations, federal RCRA rulemaking proceedings and environmental rulemaking proceedings in several states.

Outside the Office

Bob is an avid wildlife photographer who especially enjoys viewing and photographing animals on safari in Africa. He’s a fly fisherman and pursues trout in the Ozarks, though not nearly as often as he’d like. More exotically, he has fished for bass in Malawi. He plays the trumpet and loves spending time with his three grandchildren, one in St. Louis and two in Charlotte, North Carolina.
