Overview

Kyle is a registered patent attorney focusing his practice on patent portfolio management, patent litigation and intellectual property counseling.

Kyle works closely with multinational corporate clients as well as innovative new-growth startups at all phases of advancing and protecting their ideas and innovations. He represents clients across a wide range of sectors, including:

  • Home automation and security
  • Automotive components
  • Retail merchandising
  • Consumer electronics
  • Construction equipment
  • Telecommunications
  • Digital and analog control systems

He regularly analyzes and prepares patentability and freedom-to-operate opinions, as well as preparing and prosecuting patent applications, both domestically and internationally. In his patent litigation practice, he has significant experience in drafting infringement, noninfringement and invalidity opinions; performing claim construction analyses; and drafting complaints, motions and memoranda. Kyle also represents both petitioners and patent owners in post-grant proceedings in front of the U.S. Patent and Trademark Office (USPTO). In addition, he drafts asset purchase agreements and licensing agreements relating to patents and trademarks on behalf of clients.

  • Obtained favorable outcome in defending construction equipment manufacturer against patent infringement allegations.
  • Second-chaired Markman hearing defending home security company in complex patent suit involving multiple patents.
Outside the Office

Kyle enjoys performances at the Chicago Symphony Orchestra and musical theatres. He also regularly attends sporting events at his alma mater, University of Notre Dame. In addition, he mentors current law students who are interested in IP, and keeps up with his friends and fellow Domers through the local alumni association.
