Overview

As an experienced business litigator and trial attorney Jennifer primarily represents commercial lenders and lessors in creditors’ rights issues throughout the country.

She quickly assimilates intricate commercial and legal matters in order to deliver targeted strategies, especially in insolvency and bankruptcy matters. Among her accomplishments in the financial services industry:

  • Litigation team leader in representing Fortune 100 commercial lender in inventory collateral recovery and pursuit of deficiency claims involving more than 1,000 floor-plan lending cases.
  • Lead counsel in loan and account default litigation for a regional distributor and servicer of power generators and large-vehicle engines.

In addition to her extensive commercial litigation experience, Jennifer serves as trial counsel in construction litigation, employment law matters and commercial fraud claims. She advises on general litigation, loan documentation, employee and independent-contractor issues and corporate formation and has led training for in-house counsel and corporate leaders on emerging legal issues.

Jennifer assisted in the development of the firm’s Extra AdvantageSM Case Management System, where clients have extranet access to shared private files and reports and attorneys can achieve efficiency and cost-savings for clients in the management of their cases. She is also the e-discovery liaison for financial services litigation. In addition to assisting her clients with e-discovery needs, Jennifer has presented on topics such as e-discovery developments in bankruptcy courts.

Before her law practice, Jennifer was an accountant with a major public firm and concentrated on financial institution audits and loan valuations.

Experience
  • Lead trial counsel for financial institution in matters such as lender liability, defaults and priority disputes in arbitration proceedings and state and federal courts throughout the country. Issues involved economic losses due to withdrawal of financing, fraud and interference with contracts, among others.
  • Litigation team leader for national creditors, various defensive claims including FRCA, TCPA, FDCPA and similar state-based actions.
  • Lead counsel on premises liability and various negligence claims for national quick stop company.
  • Lead counsel for the creditor in a loan default resolution for the largest RV Dealer in Southern California.  Matter involved Arbitration, Federal Court, Bankruptcy filings, and third-party purchaser negotiations and appointment of a Receiver.
  • Lead trial counsel for national auto-finance companies on consumer loan litigation, dealer disagreements and “keeper” issues.
  • Lead counsel for loan and account default litigation for a regional distributor and servicer of power generators and large-vehicle engines. Representation included construction claims relating to private and government bonds.
  • As litigation team leader, coordinated and managed a team of attorneys in representing Fortune 100 commercial lender throughout the United States in more than 1,000 significant-sized floor-plan lending cases involving retail dealers in a variety of industries. Outside national counsel position encompassed inventory collateral recovery efforts for a variety of industries and pursuit of deficiency claims in federal and state courts, as well as alternative dispute resolution forums.
  • Lead counsel representing auto manufacturing company in dealer franchise litigation throughout Tennessee and Arkansas.
  • Litigated for international manufacturer of industrial ovens in a dispute over the performance of a subcontractor’s conveyor belts in auto manufacturing plant.
  • Lead counsel for a trucking floor-plan finance company on a defaulted multimillion-dollar loan purchased as part of a bank closed by the Federal Deposit Insurance Corp. (FDIC), spanning multiple locations and creditors. Negotiated settlement favorable to client.
  • Advised and successfully litigated on behalf of distribution and transportation company in independent contractor and employee issues, ranging from third-party liability cases to wage and hour class-action conflicts.
  • Lead trial counsel for regional grain elevator in lien and tort claims litigation, as well as disputed zoning issues.
  • Title 31 Mediator certified in Arkansas.
  • Works with Regional Agribusiness retailer on real estate business, employment and credit issues throughout the Mid-South.
  • Appointed as attorney ad litem by Circuit Court Judge to represent elderly client in contentious family dispute involving farmland, living arrangements, and expenditures out of joint accounts. Successfully investigated and resolved matter.
  • Litigation team leader for national equipment financing company, with team litigating all types of creditor-based claims, defaults, liens, tax issues, investigations, and probate matters.
