Eric is on the front lines of advising clients in the fast-moving fields of information privacy, data breach and other technology issues. His experience with complex commercial litigation also includes insurance coverage, contract and lease disputes, collection claims, trademark and copyright actions, and eminent domain proceedings.
Eric’s counsel on cybersecurity risks includes drafting privacy policies and notices and negotiating contracts allocating data protection and data gathering risks. Eric has extensive experience with sector-specific privacy regulations, such as the Health Insurance Portability and Accountability Act (HIPAA), the Health Information Technology for Economic and Clinical Health Act (HITECH) and the Family Educational Rights and Privacy Act (FERPA). He also advises clients on cyber-insurance policies.
When a data breach occurs, Eric is on hand immediately. He understands the reputational and financial costs of a data breach, and he works to represent clients during the incident investigation, advise on U.S. and international breach notification requirements, and provide support and counsel throughout the breach response.
Eric has received the Certified Information Privacy Professional (CIPP-US) designation from the International Association of Privacy Professionals (IAPP).
