Eric is on the front lines of advising clients in the fast-moving fields of information privacy, data breach and other technology issues.

His experience with complex commercial litigation also includes insurance coverage, contract and lease disputes, collection claims, trademark and copyright actions, and eminent domain proceedings.

Eric’s counsel on cybersecurity risks includes drafting privacy policies and notices and negotiating contracts allocating data protection and data gathering risks. Eric has extensive experience with sector-specific privacy regulations, such as the Health Insurance Portability and Accountability Act (HIPAA), the Health Information Technology for Economic and Clinical Health Act (HITECH) and the Family Educational Rights and Privacy Act (FERPA). He also advises clients on cyber-insurance policies.

When a data breach occurs, Eric is on hand immediately. He understands the reputational and financial costs of a data breach, and he works to represent clients during the incident investigation, advise on U.S. and international breach notification requirements, and provide support and counsel throughout the breach response.

  • Counseled major online retailer on response to data breach that exposed credit card information of thousands of consumers from all 50 states and 20 foreign countries. Drafted compliant notices to affected consumers, regulatory bodies and credit reporting agencies; prepared talking points for call center set up to handle consumer inquiries; and processed requests for additional information from regulators.
  • Reviewed, drafted and revised numerous privacy notices to consumers advising them of categories of data being collected and how said data would be used and/or disclosed by the client.
  • Reviewed and revised privacy policy for large nonprofit blood bank.
  • Negotiated and drafted numerous agreements between clients and third-party vendors or contractors regarding the processing and protection of personally identifiable information in the healthcare, biotechnology, education and online services industries.
