Overview

Known as a strong trial lawyer and skillful negotiator, Dan assertively protects the interests of his business clients in product liability claims and commercial disputes.

He persuasively presents the facts and argues the law at the trial and appellate levels. During jury trials, he uses creative approaches in order to effectively communicate burdensome evidence to lay juries, consistently ensuring the best possible outcomes for corporate clients. He also provides counsel in transactions for the purchase, sale and licensing of high-technology products and services.

Dan secures favorable litigation results that reduce costs for national corporate clients. His accomplishments as a litigator and a supervisor of litigation entail forming and managing multiple-role teams of national and local counsel in hundreds of cases in more than 40 jurisdictions.

Dan is currently Husch Blackwell’s full-time resident New York attorney, where he operates from several locations in the New York City metropolitan area. He handles cases throughout New York State, as well as in other jurisdictions where he is licensed, or operates with local co-counsel.

Dan’s work on behalf of industry clients has included:

  • Representing a major ammunition manufacturer since 1988 in more than 350 litigation matters, primarily involving product liability defense but also in contract disputes, premises liability, personal injury and wrongful death cases.
  • Defending a manufacturer in state and federal courts against multiple lawsuits in two states to hold it liable for the criminal misuse of its products.
  • Bringing action on behalf of a national corporate client against its software provider when threatened with a shutdown of operations and obtained a temporary restraining order leading to a result which fully met the client’s goals.
  • Representing a multinational engineering and electronics company in several commercial contract disputes and product liability defense cases.

In addition, Dan has implemented programs for reducing/avoiding liability by preparing product warnings, developing and implementing recalls, training client personnel in report writing and recordkeeping, drafting contract provisions that require suppliers to indemnity clients, and developing and implementing bad venue avoidance strategies.

Dan previously served the Commonwealth of Massachusetts as an Assistant Attorney General.

Affirmation of case dismissals in U.S. Courts of Appeals for the Second and Third Circuits and the appellate division of the New York Supreme Court.
